What: Help Save A.2529 (Conditional Veto version) by calling and sending a faxed letter (and email) to Speaker Shelia Oliver of the Assembly Democratic Majority asking for her to post this bill for a vote.

Why: Speaker Oliver (D-34) is holding up the bill, which is the last chance for
4 months for the bill to become law and help save the jobs and business in the NJ
Net-Metered Solar Industry, and their subcontractors and suppliers. After June
30th, the Legislature will likely adjourn until after the election in November and
not come back until December for a lame duck session.? See further details below
on this necessary legislation.

How:? Call Speaker Oliver's District Office:? 973-395-1166 and call and fax the

Ask to speak with the Chief of Staff in both her district office and at the majority
office.? Calls are taken at the Majority Office until 5:30 pm AND FAXES RECEIVED

to post A.2529 for a vote by June 30th.? This bill is critical for the survival
of NJ's net-metered solar industry and we support the Governor's Conditional Veto
to support the BPU's authority to review large solar projects over 10 MW.? Without
this review, NJ's existing solar industry and its 3,000 employees could face lay-offs
from the oversupply of Solar Renewable Energy Certificates from very large solar
farms.

BACKGROUND: We have information that opposition to the approval of A.2529 Governor's CV version may likely be coming from a carpenter's union in NJ.? Another possibility is from Senator Donald Norcross (D-5 Woodbury & part of Camden).? Senator Norcross introduced legislation last week that contravenes the benefits of?? A.2529 - that is, attempting to slow down very large PV installations (>10 MW) by requiring a BPU review.? is important legislation for the solar industry that seeks to redefine "connection to the distribution system" to < 69 kV and requires the NJBPU to review and approve PV projan attempt to slow down large PV installations that may create overcapacity in NJ's solar market and potentially crash the SREC.?? This legislation has been controversial because some large PV developers/integrators fought to eliminate a critical amendment MSEIA supported during the final vote? on the Senate floor and won.?? MSEIA immediately wrote to the Governor and met with his counsel to ask for the amendment to be restored.? The Governor agreed and the legislation has been pending , awaiting the legislature to concur since March.? Assemblyman Chivukula, the sponsor of the legislation, has asked for the bill to be brought up with Speaker Oliver.

Background:? What A.2529 Says:? A.2529 amends the 1999 Electric Discount and Electric
Competition Act (EDECA) to redefine "Connection to a Distribution System for a solar
ects over 10 MW before they are considered "connected to the grid",? infacility
" and net-metered as a system connected at 69kV or less.? The critical amendment
in the legislation reads: "Any solar facility >10 MW can be considered connected
to t.?? he distribution system only upon designation by the BPU, and only after
public notice and public hearings.? The BPU is ordered to consider the impact of
